Fanime Eurobeat Concert 2008--Idea and Legality Issues
(I'm posting this to two boards--one, the current boards for Fanime Con; the other, Eurobeat Prime, where Eurobeat fans (and even Eurobeat producers!) meet and greet about the 'beat. As such, this is sort of generically prepared...)
I'm considering joining the Band lineup at Fanime as a sort of Eurobeat cover band with a few original tunes (see HERE and HERE for examples of how the pros have pulled it off... I might do something more towards the former). The basic layout would be me (vocalist/keytarist), one guitarist, maybe a bass player, and (more likely) a female backup vocalist that may have some songs of her own, along with some willing paralists (Parapara dancers, for the uninitiated). The background tracks would be played and sung over by the on-stage musicians, meaning the guitar and vocal tracks (and, in some cases, the synth lines) would be muted or cut out. Some songs might have changed (raised/lowered) keys; others might be just as-is. (No band names yet)
Current setlist ideas:
*Deja Vu -- Dave Rodgers (ABeatC)
*Ganguro -- Franz Tornado and the Yamnaba Girls (Hi-NRG Attack)
*Baby Make Up Your Mind -- Wain L (ABeatC)
*India In The Sunrise -- Odyssey (That's me~!)
*Running In the 90's -- Max Coveri (Delta)
*Suck A Bazooka -- Franz Tornado & the Suck A Bazooka Girls (Hi-NRG Attack)
*Forever Young -- SYMBOL (Time)
*<One> -- Odyssey
We'd have more prepared in the event of requests and/or encores.
Questioning:
*Is there any way to do this gig as a "non-profit", meaning that this band gets no money for performing the covers (and therefore wouldn't be infringing any copyrights)?
*Would AVEX (the owners of Super Eurobeat) pee their pants after having an aneurysm over this or not?
I'm a bit worried that AVEX, who's been generous enough to send m.o.v.e over here stateside, would see this as a HUGE form of copyright infringement, and, in BEST-case, only sue the musician(s) involved (mostly involving me); in WORST-case, sue Fanime as a whole! Would anyone know the legal ramifications of this sort of thing? Should I try to get this to work? Abandon it altogether? Try to reach a compromise, or otherwise just have AVEX send those artists stateside altogether?

You should bring this up with the organizers of the convention. If you're performing this publicly, non-profit or not, you need to have the performance rights. These (I believe) actually go to the songwriters (through collection agencies like ASCAP and BMI (USA), SOCAN (Can), JASRAC (Japan), SIAE (Italy) and so on), so if it's covers, *Avex* might not be able to say much (unless they own the performance rights as well).
Essentially, you *can* get in legal trouble from this, although it's most likely going to fall on Fanime and/or the host location to have obtained the rights. And this has happened recently with the performance collection agencies going after coffeeshops that hosted live bands, that played cover songs that have been assigned to that particular agency, where the coffeeshops did not have the proper rights. Although, odds are the establishment the convention is at already has an agreement with BMI and/or ASCAP, unless someone's really screwed up somewhere.

JASRAC manages the copyright including performance rights.
So when using the songs, we have to get their permission
at least in Japan.
I don't know if this goes also for overseas ppl, though.

Great idea, But I would get everyones permission that is needed. It would really be unfortunate to be sued by the people whose music you adore. Back when I used to Deejay in the 90's. I would include a set of TIME,ASIA,FLEA,etc.., but that was different because those records were meant for dee jaying. You never know with all these loopholes

Contini and LED are also tied into ASCAP (although ASCAP's site lists Contini as SIAE). HRG's cds are registered to SIAE, but on their site, they mention winning a JASRAC award.

As I told you in a previous thread a while ago, those tracks aren't necessarily "new" or foreign to us considering there was an entire thread devoted to these unreleased tracks about six months ago. The SCP list is probably fresh to some, but I knew about it months ago as well from some blog. as far as SCP goes, I really love Fastway. I saw a few unreleased songs with the heading FR Trick Or Treat. Could that mean they will be relesed in TIME for October.
Also why are all his D.J Zorro songs have latin Titles? Does he sing in Spanish. I hardly see Spanish and Tecno music mixing well

Fastway is also the name of a band. Trick Or Treat is one of the songs by that band. As for Jay Lehr he is SCP but a lot of the songs released or still to be released still aren't up on there for not only SCP but also A-Beat C.
